Terms of Service — Niche Busters

Welcome to Niche Busters ("Niche Busters", "we", "us", "our"), operated by NICHE BUSTERS ("Company"), a Texas limited liability company with its principal place of business at 3245 Main St. Ste.235 #304, Frisco, TX 75034. These Terms of Service ("Terms") govern your access to and use of our website, applications, APIs, and related services (collectively, the "Service"). By creating an account, subscribing, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

1a. Business Intelligence Profile Required Before Any Analysis

The Small Business X-Ray™ and every other personalized analysis in the Service — including free teaser analyses, paid scans, assessments, competitive analysis, scoring, and recommendations — require a signed-in account and a completed Business Intelligence Profile before the analysis is performed. Static samples and generic examples published on our public pages are illustrative only, contain no findings about your business, and are labelled as samples. Where a purchase is involved, you select the offer, create or confirm your account and profile, payment is then processed, and the analysis runs only once both payment authorization and the required profile information are valid. Findings are inferences drawn from the information you supply and publicly available signals; they are estimates for planning purposes and are not guarantees of revenue, sales, customers, rankings, profit, growth, or return on investment.

2. Accounts — Single User Only, Non-Transferable, Non-Monetizable

Your account is personal, non-transferable, and intended for the sole use of the named account holder only. You may not share your login credentials, password, API keys, or session tokens with any other person, entity, or third party. You may not allow any other individual — including employees, contractors, clients, friends, or family — to access or use the Service under your account, whether by direct login, screen sharing, proxy access, or any other means.

You are strictly prohibited from monetizing, reselling, sublicensing, white-labeling, bundling, or otherwise commercializing access to the Service or any of its outputs. This includes, but is not limited to: selling reports or data to clients, offering "managed niche intelligence" services powered by the Service, embedding outputs into paid products without authorization, or using the Service as a backend for any commercial offering. Violation of this clause will result in immediate account termination, forfeiture of any prepaid fees, and may result in legal action for breach of contract and unjust enrichment.

Terms Acceptance and Commercial Use Declaration. Personal-use plans (Business Gap Scan, QuickScan Business Report, Strategic Intelligence Report, Strategic Intelligence Intensive — Automated, Strategic Intelligence Intensive — Expert Reviewed, 90-Day Competitive Growth Plan, Niche Busters Pro, Starter and Pro) grant the named account holder an internal-use license for their own business only. They may not be resold, white-labeled, sublicensed, or delivered as paid client work. Commercial and client-facing use requires an agency-track license (Solo Consultant, Agency, Intelligence Suite and Enterprise), and is permitted only within the limits of the applicable agency agreement.

3. Subscriptions, Billing & Auto-Renewal

Recurring plans (Niche Busters Pro, Starter, Pro, Solo Consultant, Agency and Intelligence Suite) bill in advance and renew automatically until cancelled.
The billing cadence shown on the pricing card and at checkout is the cadence you are charged on — monthly, quarterly, or annual.
Cancelling stops the next renewal only; already-billed periods are not pro-rated except where the refund policy says otherwise.
One-time purchases (Business Gap Scan, QuickScan Business Report, Strategic Intelligence Report, Strategic Intelligence Intensive — Automated, Strategic Intelligence Intensive — Expert Reviewed and 90-Day Competitive Growth Plan) are charged once and never create a subscription.
Monthly allowances reset each period and do not roll over; separately purchased credits expire twelve (12) months after purchase.
One-time products are covered by Section 4. Fees are exclusive of taxes, which you are responsible for where applicable.
We may change pricing with at least 30 days' notice; changes apply to the next renewal.
Credits do not roll over. Monthly plan credits, scans, and usage allowances are granted for a single billing period and reset at the start of each new period. Unused amounts are forfeited at reset and do not accumulate, carry forward, transfer between accounts, or convert to cash, refunds, or account balance.
Purchased credits expire after one year. Any credits bought separately from a plan are applied on top of the current billing period’s allowance and expire twelve (12) months from the date of purchase. Within a billing period, monthly plan credits are consumed first, then purchased credits in order of oldest purchase date. Expired credits are forfeited, are not refundable, and have no cash value.

3a. Upgrade Credits

Apply what you paid for the Business Gap Scan toward 90-Day Competitive Growth Plan within 7 days.

The credit equals the amount actually paid for the Business Gap Scan, excluding taxes and any separately purchased add-ons.
It can be applied once, by the purchasing account only, within 7 calendar days of the original purchase.
It applies only to an eligible quarterly membership and has no cash value.
It cannot be combined with itself, split across purchases, transferred, or reissued after expiry.
Once applied, the credited amount is no longer separately refundable under the one-time report refund terms.

If an upgrade credit has been applied, the credited amount is treated as consumed toward the 90-Day Competitive Growth Plan and is no longer separately refundable under the one-time report terms. Credits expire 7 days after the original purchase and have no cash value.

4. One-Time Purchases — Quick Reports, Vendor Event & Commerce Reports

In addition to subscriptions, the Service offers one-time, non-recurring digital products, including NICHE BUSTERS Quick Reports (QuickScan Business Report and Strategic Intelligence Report), Vendor Event Profitability Scanner™ reports (Single Event Snapshot, Two-Event Comparison, Three-Event Market Season Starter, Full Vendor Event Profitability Report, and organizer-facing packages), and NICHE BUSTERS Commerce reports (Profit Leak Scan, Trust Leak Scan, Price Power, Profit Priority Engine).

One-time purchases are charged once through Stripe and do not create a subscription or recurring charge.
Each purchase entitles the named purchaser to one report for the specific business, brand, event, or commerce scenario submitted. It is not a license for repeat use, resale, or client-facing delivery.
Some verticals — including Vendor Event reports — operate on a submit intake, scan, then pay to unlock basis. Submitting an intake is free and does not obligate you to purchase; the full report stays locked until payment completes.
Report quality depends on the accuracy and completeness of the information you submit at intake. Inaccurate or incomplete inputs reduce accuracy and are not grounds for a refund.
Delivery timing estimates are targets, not guarantees. Turnaround may vary with AI provider availability and review load.
Vendor and organizer intake portals are provided for the submitting party’s own event participation decisions only.

Refund treatment for one-time purchases is described in our Refund Policy.

5. Event, Organizer, Commerce & Third-Party Information

Vendor Event, competitor, prospect, commerce, trust, customer-market fit, and business-impact intelligence outputs are strategic estimates based on user-provided inputs, visible public-facing information, and AI-assisted interpretation. They are not factual findings about, or accusations against, any event organizer, venue, competitor, business, or individual. You may not publish, distribute, advertise, or present these outputs as verified factual claims, credit or trustworthiness determinations, or defamatory statements. Booth-fee, break-even, attendance, profitability, pricing, margin, customer-fit, and trust figures are estimates only, are not financial advice, and do not guarantee sales, foot traffic, weather conditions, organizer performance, customer behavior, demand, or return on investment.

5a. BUYERFIT™ and Invitation-Only Modules

Certain modules — including BUYERFIT™, the Cross-Cultural Revenue Gap Analyzer™ (internal, admin-only), the Community Trust & Retention Analyzer™ (internal, admin-only), the Trust & Cultural Alignment Intelligence Engine, and other pilot tools — are made available to admins and invited testers at our discretion, may change or be withdrawn at any time, and are provided without any service-level or availability commitment. Where BUYERFIT™ Verify mode accepts a customer or order CSV, that file is processed in your browser; only the column mapping and aggregate data-quality metrics are stored. You remain responsible for having the right to use any customer data you map, and you must not map or submit sensitive personal data, payment card data, or health information.

Cross-Cultural Revenue Gap Analyzer™ output is strategic decision support only. It does not determine individual motives, prove discrimination, or produce legal conclusions, and it must not be used for lending, employment, housing, insurance, education, healthcare, or government-benefit decisions, or to exclude or target people based on protected characteristics. PDF export is restricted to admin-approved analyses and every export carries the required disclaimers, prohibited-use list, and methodology version metadata.

5b. Local Visibility Launcher™

The Local Visibility Launcher™ ("LVL") matches your business or event to local visibility opportunities (community calendars, newsletters, publications, directories, partnerships, and paid placements), scores each with a Local Advertising Fit Score™, and drafts submission-ready promotion copy.

LVL is a discovery, scoring, and drafting tool. We are not your agent, media buyer, or representative, and we do not contract with outlets on your behalf.
Outlet details — fees, deadlines, audience size, and acceptance rules — are gathered from public-facing sources and may be outdated or incorrect. You must verify them directly with the outlet before submitting or paying anything.
Distribution is assisted, not automatic: you submit the generated materials. Automated submission is off by default and only occurs where an outlet permits it and you enable it.
We do not guarantee placement, publication, reach, attendance, leads, or sales. Fit scores, cost estimates, and reach estimates are decision-support estimates only.
You are responsible for the accuracy and legality of any listing you submit, for holding the rights to any logo, image, or content you upload, and for complying with each outlet’s rules and applicable advertising law.
Paid LVL packages are one-time purchases except where a plan is explicitly described as recurring. Package entitlements expire twelve (12) months after purchase.
Published campaign pages hosted at /lv/ addresses and their tracking links may be suspended or removed if the content is inaccurate, unlawful, or violates these Terms. Campaign analytics (views, clicks, self-reported results) are aggregate estimates, not audited metrics.

5c. NICHE BUSTERS Strategic Advisor

The Strategic Advisor is an AI assistant that reads your own saved reports and returns prioritized suggestions and draft action plans. It is decision support only and is not legal, financial, investment, tax, or professional advice. Answers may be incomplete, outdated, or wrong and must be reviewed before you act on them. Advisor use consumes plan credits and is subject to per-plan request, length, and spend limits shown in the app. We may pause, throttle, or withdraw Advisor availability at any time — including via an emergency pause — without affecting your existing saved plans, reports, or exports.

5d. NicheMeld™ Collaboration Intelligence

NicheMeld™ is the activation layer of NICHE BUSTERS: it helps you structure an opportunity, define the roles a collaboration may require, evaluate candidate partners, and produce a Winning Team Playbook™ or Team Blueprint before anyone commits.

NicheMeld is a planning and decision-support tool. It is not an employment agency, staffing firm, broker, medical or professional referral service, licensing authority, background-check provider, or insurer, and it does not create any legal partnership, joint venture, agency, or employment relationship between you and anyone else.
Matches are potential fits only. We do not verify identity, credentials, licensing, insurance, financial standing, or capability, and we do not guarantee that any partner will respond, commit, perform, or behave lawfully or ethically.
Blueprints, playbooks, role definitions, revenue splits, cost estimates, and financial scenarios are estimates and drafts, not contracts, valuations, accounting, tax, or legal advice. Have your own counsel and accountant review any agreement before you sign or exchange money.
Discovery and invitations are opt-in. Your profile is only shown to other participants after you enable discovery, and blocks and mute preferences are honored.
Data moved from a NICHE BUSTERS report into NicheMeld requires your affirmative confirmation on a review screen that shows exactly which fields will transfer. You may edit or cancel before anything is created.
Execution workspaces, reliability scores, and outcome reporting are limited-availability pilot features. Self-reported outcomes and reliability signals are participant claims, not audited facts, and may be withdrawn, reset, or changed as the pilot evolves.
You are solely responsible for how you conduct, contract, insure, staff, and deliver any collaboration you pursue, and for complying with all applicable law in your industry and area.

5e. Community Intelligence & Reactivation Pilot

The Community Intelligence & Reactivation Pilot is a free, invitation-reviewed program for community administrators, limited to a small number of founding groups. Applying is free, creates no payment obligation, and does not guarantee acceptance; when capacity is full, qualifying applicants are placed on a waitlist.

Community Health Scores, engagement-leak reads, member-problem classifications, content opportunity scores, and sprint results are deterministic, versioned estimates built from the figures and summaries you enter. They are not audited analytics, platform-supplied data, or guarantees of engagement, growth, attendance, revenue, or member behaviour. Where inputs are too incomplete, we report INSUFFICIENT DATA instead of a score.
AI-assisted findings are heuristic drafts presented with evidence and a confidence level. A person must review, edit, or reject each one, and AI never changes a deterministic score.
We never ask for your platform password, never access your group on your behalf, and never scrape member data. You supply typed summaries, screenshots, or a de-identified export, and personal identifiers are removed before analysis.
Reporting is aggregate only. Individual members are never scored, and member information is never sold, rented, or shared with third parties. Protected characteristics are never used as scoring inputs.
Outreach to your members requires their consent and remains your responsibility as the community administrator. You must comply with your platform’s terms and community guidelines.
Sprint content is drafted for your approval and published manually by you. Nothing is posted automatically to Facebook or any other platform.
Consent for live analysis, participation, and continued data retention may be withdrawn at any time; on withdrawal we archive or delete pilot records as described in the Privacy Policy.
The pilot is a limited-availability program provided without service-level commitment; capacity, structure, and availability may change or end at any time. Places are limited and set by us, are offered only by a reviewer, and a waiting list position confers no entitlement to a place or a date.
We publish pilot results on our public site only with your prior written permission, which we record before publication. Each write-up is prepared by a person, states how and when the figures were measured, and omits your community’s name unless you ask us to include it. You may ask us to remove a published write-up at any time. Published figures describe a single community over a single period and are not a projection or promise for any other participant.

5f. Founding Growth Cohort

The Founding Growth Cohort is a selective 90-day program with a limited number of places. Applying is free and does not create a subscription, an account entitlement, or any obligation on either side. Selection is at our sole discretion based on fit, capacity, and readiness. Recommendations, implementation support, and measured progress are decision-support work products and estimates, not guarantees of revenue, leads, rankings, customers, or funding. Any outcome we publish is labelled with the evidence behind it and is used only with the participant’s permission, which may be withdrawn. Program phases, capacity, and availability may change or end at any time.

5g. Serious Business Score™ Calibration Pilot

The Serious Business Score™ is in a controlled calibration pilot and is available by invitation only. It is not publicly available, is not offered as a self-service assessment, and no public teaser version exists. Applying is free, creates no payment obligation, and does not guarantee an invitation.

The score places a business at Hobby, Hustle or Serious Business level from 24 behaviour-based answers across eight equally weighted operating areas, using a fixed, versioned scoring method. It does not ask about revenue, headcount, business age or location.
Results are estimates for planning only. They are not a valuation, a credit or risk rating, an audit, professional advice, or a guarantee of revenue, profit, growth, leads, rankings or business survival.
During calibration, results are compared against blinded reviewer classifications and participant feedback so we can test accuracy. Scoring settings and thresholds may be revised, and every result is retained with the method version that produced it.
Invitations are personal, single-use, and non-transferable. Participation may be paused, withdrawn, or ended by either side at any time, and places are limited and set by us.
Consent to take part is recorded separately from permission to display or publish anything about a participant. Nothing a participant submits appears publicly, in a live demonstration, or in marketing without that separate written display permission, which may be withdrawn.
Score results feed Stack Builder recommendations and the progression dashboard for the participant only. Recommendations remain estimates and never include tools outside the participant’s plan.

5h. Audience Independence Score™, Self-Reported Score™ and the Business Adoption Program

The Audience Independence Score™ (with its Platform Dependency Risk™ reading) and the Self-Reported Score™ are controlled-pilot diagnostics. Both require a signed-in account and a completed Business Intelligence Profile before any result is produced; there is no anonymous assessment and no self-service or paid version. Taking part is free and creates no payment obligation.

Both scores are calculated only from answers you give about your own business, using a fixed, versioned method. NICHE BUSTERS does not connect to, log into, audit or measure any platform, advertising account, email tool, website or customer list, and does not verify what you enter.
Results are self-reported estimates for planning only. They are not audited analytics, a valuation, a credit or risk rating, an audit, professional advice, or a guarantee or prediction of revenue, customers, leads, followers, reach, rankings, account status or business survival. No result states or implies that any platform will restrict, suspend or penalise your business.
The Reality Gap™ is the arithmetic difference between your own self-rating and your own most recent completed Audience Independence Score™. It is not a verification, fact-check, accuracy finding, or judgement of honesty or competence. Where you have not completed an Audience Independence Score™, no gap is calculated.
Incomplete assessments produce no score. Completed results are retained with the method version that produced them and are never overwritten by a retake, so your history remains intact. Scoring settings and thresholds may be revised while the method is calibrated with real businesses.
Results add signal to your own Stack Builder recommendations and progression view only. They do not change any other score, and recommendations never include tools outside your plan.
The Business Adoption Program is an internal, invitation-reviewed program with limited places. Phases (baseline, day 30, day 60, final), review windows, structure, capacity and availability are set by us and may change or end at any time. Either side may pause, withdraw or end participation at any time, and we may add a business we are working with directly at our discretion.
Program records — phase, status, score timelines, program averages and internal notes — are administrative working records, not published findings, ratings or endorsements, and are restricted to your account and our administrators. Program-wide averages describe participating businesses over the period measured and are not a benchmark or projection for anyone else.
Consent to take part is recorded separately from permission to display or publish anything about you. Nothing you submit, and no score or movement, appears publicly, in a live demonstration, or in marketing without your separate written display permission, which you may withdraw. You may ask us to delete your assessment and program records at any time.

6. Demo Events & Live Gap Snapshot Applications

Demo Event registration and the optional Live Gap Snapshot candidate application are free. Submitting an RSVP or application does not create a paid subscription, guarantee attendance, or guarantee selection for a live snapshot. Event details (date, time, location, format, and capacity) are subject to change; we will notify registrants of material changes by email. Live Gap Snapshot selections are made at our sole discretion based on fit, capacity, and readiness. Selected candidates may be offered a paid or complimentary scan; acceptance of any offer is optional. Where a demo event is promoted through a community pilot, registrations referred by that community are attributed to it for reporting purposes only.

7. Acceptable Use

You agree NOT to:

Reverse engineer, scrape, or resell the Service or its outputs as a competing dataset.
Use the Service to generate content that is unlawful, defamatory, harassing, infringing, or that violates third-party platform rules (YouTube, TikTok, Reddit, etc.).
Attempt to bypass quotas, rate limits, authentication, or tier gates.
Upload malware, attempt intrusion, or interfere with other users.
Use the Service to make decisions about credit, employment, housing, or legally protected categories.
Share, transfer, or resell your account, credentials, or access in any form whatsoever.
Use the Service as a backend for any third-party service, SaaS product, or client deliverable without express written authorization.

8. AI Outputs & Third-Party Data

The Service uses large language models and third-party APIs (including YouTube, Reddit, and other platforms) to surface trends and generate reports. AI outputs may be inaccurate, incomplete, or out of date. You are solely responsible for reviewing outputs before relying on them. We do not guarantee that any content strategy, hook, or prediction will produce a specific result (audience growth, views, revenue, etc.).

9. Your Content & License

You retain ownership of the niches, prompts, and inputs you submit ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to process Your Content solely to operate, improve, and secure the Service. We do not sell Your Content. We may use aggregated, de-identified usage data for analytics and product improvement.

10. Reports & Generated Output

Reports, calendars, hooks, and other materials generated by the Service ("Output") are provided to you under a non-exclusive license to use within your business. You may not republish raw Output as a standalone dataset or competing intelligence product. You may not sell, license, or otherwise commercialize Output to third parties.

10a. Controlled Pilot: Alerts, Sponsored Places & Market Reporting

Alerts. We raise an alert only when a change appears material. Alerts are estimates and observations, not predictions, and acting on one is your decision. In-app alerts are included; email requires consent; text and push are limited to eligible plans, and recurring texts require separate explicit consent. Message and data rates may apply, and you may opt out at any time.
Sponsored places. A sponsor may fund a limited number of snapshots or sprints. Sponsorship buys access only. A sponsor cannot influence, soften, delay, or suppress any finding, cannot receive identifiable information about you without your explicit permission, and cannot contact you through the Service. Sponsored access is subject to eligibility rules, availability, expiration, and administrator approval, and may be withdrawn. No sponsorship creates a guarantee of any result.
Market reporting. Aggregate market reporting describes groups of businesses, applies minimum group sizes and small-group suppression, and requires administrator approval before any publication. Nothing is published publicly during the controlled pilot.
Pilot capabilities may change or be withdrawn at any time, and their availability is not part of any subscription entitlement. Pricing is unchanged by pilot participation.

11. Intellectual Property

The Service, including software, design, branding, and underlying models we have built, is owned by the Company and protected by intellectual property laws. Except for the rights expressly granted, no license is granted to you.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that any specific outcome will be achieved. See our Disclaimer for details.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE COMPANY, ITS AFFILIATES, OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING OUT OF OR RELATED TO THE SERVICE. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT OR (B) USD $100.

14. Indemnification

You agree to indemnify and hold the Company harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party right.

15. Termination

We may suspend or terminate your access at any time for breach of these Terms or to protect the Service. You may close your account at any time. Sections that by their nature should survive termination (IP, disclaimers, liability, indemnity, dispute resolution) will survive.

16. Changes to the Service or Terms

We may modify the Service or these Terms. If material changes are made, we will provide notice (e.g., via email or in-app). Your continued use after changes take effect constitutes acceptance.

17. Governing Law & Disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Collin County, Texas. You waive any right to participate in class actions to the extent permitted by law.
